SAIJAI.IO — DISCLAIMER
The Saijai.io website and any related platforms operated by Baan Saijai Co., Ltd. ("SAIJAI") function solely as an information display service. SAIJAI does not act as a marketplace, broker, agent, employer, recruiter, service provider, or party to any engagement between users. This Disclaimer forms part of, and should be read together with, the Terms of Service and Privacy Policy of SAIJAI.
1. Nature of the Platform
1.1 SAIJAI.IO is a passive information display where Service Providers self-submit their profile information and Service Inquirers may view that information. SAIJAI does not match, arrange, verify, endorse, or otherwise take part in any communication, arrangement, transaction, or service between Service Providers and Service Inquirers.
1.2 SAIJAI does not carry out, host, facilitate, or process any financial transactions of any kind through the website or through any other channel, platform, or communication of SAIJAI. Any payment, deposit, or exchange of consideration between a Service Provider and a Service Inquirer takes place entirely outside of SAIJAI and is not the responsibility of SAIJAI in any respect.
2. No Employment, Agency, or Recruitment Relationship
2.1 SAIJAI is not an employer, joint employer, principal, agent, representative, or recruiter of any Service Provider. SAIJAI does not operate a recruitment service under the Employment and Job Seeker Protection Act B.E. 2528 or any equivalent or successor legislation.
2.2 Service Providers act at all times as independent parties. Any decision, communication, negotiation, agreement, engagement, service, or payment between a Service Provider and a Service Inquirer is a private matter between them alone, at their sole discretion, on their sole risk, and under their sole responsibility.
3. No Vetting, Verification, or Endorsement
3.1 SAIJAI does not verify, screen, background-check, license-check, insure, endorse, recommend, or vouch for any Service Provider or Service Inquirer, or any information, credential, qualification, statement, photograph, description, rate, review, or reference displayed on the Platform.
3.2 All information displayed on the Platform is submitted by users themselves and is displayed "as-is" and "as-available" without warranty of any kind, whether express or implied, including without limitation warranties of accuracy, completeness, reliability, currency, non-infringement, merchantability, or fitness for a particular purpose.
4. Engagement is at Users' Own Risk and Responsibility
4.1 Users acknowledge and agree that any decision to contact, engage, hire, meet, allow into their premises, entrust with a minor, elderly, patient, animal, or property, receive services from, or pay any Service Provider — and, correspondingly, any decision of a Service Provider to accept an engagement, enter a premises, or provide services to a Service Inquirer — is made solely at the user's own risk and responsibility.
4.2 Users are solely responsible for their own due diligence, including without limitation: verification of identity, credentials, qualifications, insurance, criminal record, references, work permits, licences, and legal capacity of the other party; negotiation and documentation of any service agreement; determination of price, scope, schedule, and payment method; and compliance with all applicable laws, including labour, taxation, immigration, and data-protection laws.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAIJAI, ITS SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, INJURY, CLAIM, LIABILITY, COST, OR EXPENSE OF ANY KIND — WHETHER DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY — ARISING OUT OF OR IN CONNECTION WITH:
- any Service Provider's conduct, service, act, omission, negligence, misrepresentation, or crime;
- any Service Inquirer's conduct, act, omission, non-payment, or misrepresentation;
- any information submitted by any user, including its accuracy, completeness, currency, or legality;
- any death, illness, personal injury, property damage, financial loss, fraud, theft, abuse, or other harm arising from any engagement between users;
- any dispute between users, or with any third party, including regulatory authorities;
- any interruption, failure, delay, error, security incident, or defect of the Platform, its computer systems, hosting infrastructure, internet connectivity, or third-party service providers;
- any force majeure event, including without limitation natural disaster, epidemic, government action, cyber attack, or infrastructure failure;
- any user's non-compliance with these Terms, the Privacy Policy, or applicable law.
6. Indemnification
Each user agrees to defend, indemnify, and hold harmless SAIJAI and its shareholders, directors, officers, employees, contractors, agents, affiliates, and assigns from and against any and all claims, demands, actions, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with the user's use of the Platform, information submitted by the user, conduct of the user, any engagement between the user and any other user or third party, or any breach of these Terms or applicable law by the user.
7. Modifications and Governing Law
7.1 SAIJAI may modify or replace this Disclaimer at any time at its sole discretion. Modifications take effect upon posting to the Platform. Continued use of the Platform constitutes acceptance of the modified Disclaimer.
7.2 This Disclaimer is governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising out of or in connection with this Disclaimer shall be subject to the exclusive jurisdiction of the competent courts of Bangkok, Thailand.
